Terms of Service
These Terms of Service ("Terms") govern your use of the Garcon mobile application and website (the "Service"), operated by Garcon Labs LLC ("Garcon," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into a binding agreement.
2. What Garcon does
Garcon is a personal restaurant concierge. It uses artificial intelligence and data from public and third-party sources to help you discover restaurants, see information about them, and find reservation availability. Garcon does not make reservations itself and does not process payments — reservations are completed on third-party platforms such as Resy, Tock, and OpenTable, subject to their terms.
3. AI and accuracy — please read
Recommendations, descriptions, availability, hours, and other information in Garcon are generated by AI and assembled from automated and third-party data. They may be inaccurate, incomplete, or out of date. Always confirm hours, prices, availability, and any reservation directly with the restaurant or the booking platform before relying on them. Garcon is not responsible for decisions you make based on this information.
4. Your account
You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. You can delete your account at any time from within the app.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Scrape, crawl, harvest, or systematically extract data from the Service;
- Reverse engineer, decompile, or attempt to access source code, except as permitted by law;
- Interfere with, overload, or disrupt the Service or its infrastructure (including abusing the AI assistant or attempting to circumvent rate limits);
- Resell or commercially exploit the Service without our written permission.
6. Your content
You retain ownership of the content you submit (such as chat messages, notes, ratings, and saved lists). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use that content as necessary to operate and improve the Service. You are responsible for the content you submit and represent that you have the right to submit it.
7. Intellectual property
The Service — including the Garcon application, its software, design, branding, logos, and original text — is owned by Garcon and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use.
Restaurant information presented in the Service — including names, addresses, cuisines, and similar factual details — is drawn from public and third-party sources. Any third-party text, reviews, rankings, photographs, trademarks, or other content remain the property of their respective owners and are provided for informational purposes only. We do not claim ownership of third-party content, and your use of it must respect the rights of those owners.
8. Third-party services and links
The Service links to and integrates with third-party services, including Resy, Tock, OpenTable, and Google. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, their content, or their availability.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARCON AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless Garcon from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users.
13. Governing law and dispute resolution
These Terms are governed by the laws of the District of Columbia, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved by binding arbitration administered in the District of Columbia, except that either party may bring an individual claim in small-claims court. You and Garcon waive any right to a jury trial and to participate in a class action, to the extent permitted by law.
14. Apple App Store terms
If you download the app from the Apple App Store, the following also applies: these Terms are between you and Garcon, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app (including product-liability claims, claims that the app fails to conform to legal requirements, and claims under consumer-protection law) are governed by these Terms. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice in the app. Your continued use of the Service after changes take effect constitutes acceptance.
